Know Your Rights
- YOU HAVE THE RIGHT TO REMAIN SILENT,
- BUT, you must give the police certain basic identifying information;
- Your Miranda rights only have to be given to you if you are being questioned while in custody, if you are free to leave you are NOT in custody;
- In most circumstances, you should exercise your right to remain silent;
- However, you should ALWAYS remain courteous and respectful towards the police.
- YOU HAVE THE RIGHT TO HAVE AN ATTORNEY REPRESENT YOU,
- If you cannot afford one, the court will appoint one for you; however, this is after you have already been charged and arraigned;
- You do have the right to have an attorney at all investigatory stages at your own expense and you should for your protection;
- Once you invoke your right to an attorney, the police must stop questioning you, however you may inadvertently waive your right by initiating a conversation with the police.
- ANYTHING YOU SAY CAN, AND WILL, BE USED AGAINST YOU IN COURT,
- This means, ANYTHING!
- Even if you make some admissions, we can still help you minimize the effect;
- Generally, you do not have to consent to a search of your person/things/vehicle, however, the police do not always need your consent to search;
- If you do consent, you waive the right to object to the search later and anything found can be used against you;
- If you mention anything to any other person, those statements may also be used against you.
